Terms of Service

These Terms of Service (“Terms”) govern your interaction with Temp Button, a temp agency platform designed to manage human resources and payroll for staffing companies and a AI recruiter (“Ava”) that helps to facilitate meaningful introductions. By sharing your contact details and using Temp Button, you agree to abide by these Terms and Conditions.


Definitions

  • Service: Refers to the Temp Button platform and all its features, including facilitating introductions, user interactions, and AI-driven phone calls.
  • User: An individual who has provided their phone number or email via LinkedIn messaging and completed an AI phone call with Ava
  • Partner: Organizations collaborating with Temp Button to offer services within their networks and share opted-in users with Ava’s global community.
  • Profile Information: Data sourced from your public LinkedIn profile used to enable introductions.

Eligibility Requirements

Users must be 18 years or older to access Ava. By engaging with the Service, you confirm that you meet this age requirement. Users under 18 are strictly prohibited from using or accessing the platform. Ava reserves the right to verify age and may suspend or terminate accounts if the age requirement is not met.


Account Activation and Registration Process

Initial Contact

  • You initiate contact by messaging Ava’s company page on LinkedIn.
  • Ava requests your email and phone number.
  • Upon your provision of this information, Ava proceeds to the next step.

AI Phone Call and Acceptance of Terms

  • Ava will place an AI-powered phone call.
  • By participating in this call, you:
    • Agree to these Terms of Service.
    • Authorize the use of your public LinkedIn profile information.
    • Consent to being added to the matching pool.
    • Understand that your LinkedIn profile will be visible to potential matches.

You officially become a User only after completing this call. No matching or introductions occur before this step.


Marketing Consent

By sharing your email and phone number through LinkedIn messaging, you consent to receive marketing communications via email and SMS. These may include updates on features, events, partnerships, or tailored recommendations. You can opt out anytime by clicking unsubscribe in emails or replying STOP to texts.

Your sign-up also includes automatic enrollment in Ava’s newsletters and other marketing collateral which you may unsubscribe from at any point.


User Responsibilities and Conduct

Temp Button expects Users to engage respectfully with both the platform and other users. Unacceptable behavior includes but is not limited to:

  • Using offensive, discriminatory, or inflammatory language
  • Hostile or aggressive communication
  • Inappropriate personal comments or threats
  • Manipulating or misusing the AI system
  • Harassment or bullying

Violations may result in suspension or removal from Ava at the platform’s discretion. Ava reserves the right to act as necessary to maintain a safe environment.


AI Phone Call Details and Account Activation

The mandatory AI phone call helps activate your account and gather preferences. You are responsible for any phone charges incurred during this call. Information shared during the call that is publicly available (e.g., LinkedIn profile) will be used to create your profile and assist in matching. Personal data beyond public information will only be shared if both parties provide explicit double opt-in consent.


Privacy and Data Handling

Temp Button prioritizes user data protection:

  • Email addresses are only exchanged after mutual opt-in.
  • Phone numbers remain confidential and are never shared between users.
  • Public LinkedIn profile data is used solely for facilitating introductions.
  • All data is managed per Temp Button’s Privacy Policy.

Internal Data Usage

Temp Button’s team monitors:

  • User conversations with the AI
  • Email correspondence
  • LinkedIn messages
  • Behavioral data

Purpose of monitoring includes preventing abuse, improving services, resolving issues, and maintaining quality. User data access is strictly controlled; no export or unauthorized use occurs. Aggregated anonymous data may be used for analytics.


Third-Party AI Services

Temp Button uses third-party AI providers (such as OpenAI and Anthropic) for processing interactions. This may include:

  • Conversation content
  • Provided profile information
  • Public LinkedIn data
  • Call transcripts and recordings

These providers follow their own privacy policies and security protocols, retain data per their terms, and adhere to confidentiality standards.


Matching process and service use

By using Ava, you understand:

  1. Your public LinkedIn profile will be visible to potential matches.
  2. You will enter the matching pool after completing the AI call.
  3. Matches can view your LinkedIn profile before connecting.
  4. Email addresses are shared only after explicit mutual consent.
  5. Phone numbers remain private at all times.

Safety and well-being

Temp Button emphasizes user safety but is not a substitute for professional advice (mental health, legal, etc.). If conversations feel inappropriate or concerning, discontinue them immediately and contact support for assistance.


Partner network collaboration

Ava partners with organizations to broaden introduction opportunities. Opting in via a partner means your profile is included in both the partner’s network and Ava’s global matching pool.


Feedback Policy

Providing feedback grants Temp Button a worldwide, royalty-free, irrevocable license to use, modify, and integrate your comments into its services without limitation.


Intellectual Property Rights

All content, features, and functionality of Temp Button remain the exclusive property of Temp Button and its licensors. You may not copy, modify, or distribute any part of the Service without prior written permission.


Fees and Charges

Currently, Ava is free to use. Users are responsible for any charges imposed by their phone carriers related to calls with Ava. Should fees be introduced later, users will receive advance notice; continued use after notification implies acceptance.


Limitation of Liability

Ava provides connections on an “as-is” basis without guarantees of success or specific outcomes. It is not liable for indirect, incidental, special, or consequential damages arising from use of its services to the fullest extent permitted by law.


Disclaimer of Warranties

The Service is offered “AS IS” and “AS AVAILABLE” without warranties regarding operation, availability, or meeting user expectations.


Governing Law and Jurisdiction

These Terms are governed by Delaware state law in the United States. Any disputes will be resolved exclusively in Delaware courts.


Changes to Terms

Temp Button may update these Terms occasionally. Significant changes will be communicated by email or platform notifications. Continued use after updates means you accept the revised Terms.
